Assault

Australia takes accusations of assault very seriously. No matter how trivial the incident may have seemed, assault is considered an offence against the person, so the charges should not be regarded lightly. Depending on the severity of the act, different assault offences have varied consequences; nonetheless, the maximum punishment for all assault crimes is a jail sentence. Depending on the type of offence committed, the circumstances surrounding the offence, and the offender’s prior criminal history, the magistrate or judge may or may not impose a prison sentence.
A person may be assaulted by hitting, touching, moving, or using force without their consent, or with their consent if it was obtained fraudulently.

Types of assault
There are five main types of assault charges in Australia. These are:
• common assault
• assault occasioning bodily harm
• unlawful wounding
• grievous bodily harm, and
• sexual assault.

The charge that is filed will depend on the sort of injury sustained, the circumstances surrounding the incident, and the nature of the offence. In other cases, the relevant charge will also depend on who the victim is.
