Divorce in Australia

Other than the fact that the marriage has irretrievably broken down, there is no requirement for divorce in Australia.
Even if you still live together but have been separated for longer than a year, you are still eligible for a divorce as long as you swear in your divorce application that you are no longer living together.

What Am I Required To Do?
Your marriage licence, photo ID, and evidence of citizenship are required (if you were not born in Australia).

What Happens To The Kids?
Before granting a divorce, the court must be satisfied that your children are being cared for, but it will not be necessary for you to have a formal custody arrangement in place.

What About Property?
Without going to court, you and your ex-partner might be able to come to an arrangement. But keep in mind that you must file a formal application for property orders within 12 months of your divorce being complete if you can’t come to an agreement.
